Regulatory Approval for Flight Operations

14 CFR 61,91 and 135 are generally responsible for providing regulatory guidance to aircrews. The FAR’s, however, are not capable of providing guidance for every individual operator's authorizations. The additional guidance necessary for operators is therefore found in their Operations Specifications or LOA's (Letters of Authorization). Ops Specs guidance is provided by FAA Order 8900 and by specific Advisory Circulars.

 

For aircraft operators, the following hierarchy for flight operations applies:

 

  1. Individual rules established by foreign countries when more restrictive than Ops Specs or LOA's;
  2. FAA Operations Specifications and LOA's;
  3. 14 CFR applicable regulations. In plain terms, if a country establishes a regulation that is more restrictive than the individual operator's Operations Specifications or LOA (Letter of Authorization), the operator will comply with that country's regulation first, then the Operations Specifications, and then the 14 CFR Regulations.

 

Attempting to define every foreign regulation is beyond the scope of this document and is, after all, what makes flying internationally particularly challenging. Constant attention by crewmembers is required to ensure that they are in compliance with the most current ICAO and foreign countries policies and procedures. Check to see if your company has Operations Specifications relating to International Operations. They are useful in determining what can and cannot be done when operating in foreign airspace or over the high seas.
